These Terms of Service govern your access to and use of the Influgest platform and related services. By creating an account or using Influgest, you agree to be bound by these terms. Please read them carefully before using our service.
01Acceptance of terms
By accessing or using Influgest, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree to these terms, you must not use the platform.
02Description of the service
Influgest is an influencer marketing platform designed to help agencies manage campaigns, track performance, and coordinate with influencers. We may add, modify, or discontinue features from time to time to improve the service. We do not guarantee that the service will always be available or free from interruptions.
03Accounts and registration
To use certain features, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly at info@influgest.com if you suspect any unauthorised use of your account.
04Acceptable use
You agree to use Influgest only for lawful purposes and in accordance with these terms. You must not misuse the platform, attempt to gain unauthorised access, or interfere with its normal operation. Any content you submit must not infringe the rights of others or violate applicable laws.
05Subscriptions and billing
Access to paid features is subject to the subscription plan you select and the applicable fees. Fees are billed in advance on a recurring basis and are non-refundable except where required by law. We may change our pricing with reasonable notice, and continued use after a price change constitutes acceptance of the new fees.
06Intellectual property
All intellectual property rights in the Influgest platform, including software, design, and trademarks, remain the property of Influgest or its licensors. You are granted a limited, non-exclusive, and non-transferable licence to use the service in accordance with these terms. You retain ownership of the content and data you submit to the platform.
07Third-party services
The platform may integrate with or link to third-party services, such as social media platforms and payment providers. We are not responsible for the availability, content, or practices of these third parties. Your use of third-party services is subject to their own terms and privacy policies.
08Warranties and limitation of liability
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Influgest shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms excludes liability that cannot be excluded under applicable law.
09Suspension and termination
We may suspend or terminate your access to the platform if you breach these terms or engage in conduct that harms the service or other users. You may terminate your account at any time by discontinuing use and contacting us. Upon termination, your right to use the service ceases immediately, though certain provisions survive termination.
10Governing law and jurisdiction
These Terms of Service are governed by the laws of Spain, without regard to conflict of law principles. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts of Madrid, Spain. You agree to submit to the jurisdiction of these courts for the resolution of any such disputes.
